2. Use of the Platform

• The Platform allows users to create, manage, and personalize travel plans and itineraries, utilizing AI-powered suggestions and collaborative tools.
• Users must provide accurate, current, and complete information during registration and when using the Platform's features (e.g., setting travel preferences, creating itineraries).
• Misuse of the Platform, including but not limited to fraudulent activities, attempting to reverse-engineer AI models, unauthorized access to other users' data, distributing malicious software, or any activity that disrupts the integrity or performance of the Platform, is strictly prohibited.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Accounts & Subscriptions

• Certain features of the Platform may require you to create an account and may be subject to subscription fees as detailed on our Pricing page.
• You are responsible for providing accurate payment information for any subscribed services and agree to pay all charges incurred through your account for selected subscription tiers and any applicable AI usage costs or overages as defined in your plan.
• Subscription terms, including billing cycles, renewal policies, and cancellation procedures, will be specified at the time of purchase and are incorporated into these Terms.
• We reserve the right to change our subscription fees or introduce new charges upon reasonable notice, which may be provided by posting the changes on the Platform or by email.

4. AI Services and Content

• The Platform integrates Artificial Intelligence (AI) services to assist in travel planning, itinerary generation, and providing recommendations. While we strive for accuracy and usefulness, AI-generated content and suggestions are provided for informational purposes and inspiration only. We do not guarantee the completeness, reliability, availability, or error-free nature of AI-driven suggestions or outcomes.
• You are solely responsible for verifying the accuracy and suitability of any information or suggestions provided by the AI before making any travel decisions or bookings.
• KognitivAtlas is not responsible for any discrepancies, errors, or issues arising from information provided by third-party APIs (e.g., mapping services, points of interest data) that may be integrated into the Platform.
• Your use of AI features may be subject to usage limits or costs as outlined in your subscription plan.

5. User-Generated Content

• You may create and store content on the Platform, such as travel plans, itineraries, notes, and preferences ("User Content"). You retain all ownership rights to your User Content.
• By submitting User Content, you grant KognitivAtlas a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with providing and promoting the Platform, solely for the purpose of operating and improving our services. This license does not grant us rights to sell your User Content to third parties.
• You are solely responsible for your User Content and the consequences of posting or publishing it. You affirm that you have the necessary licenses, rights, consents, and permissions to publish User Content you submit.

6. Intellectual Property

• All intellectual property rights related to the Platform itself, including but not limited to its software, design, text, graphics, logos, trademarks, copyrights, patents, and trade secrets (excluding User Content), belong to KognitivAtlas or our licensors.
• You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the KognitivAtlas material on our Platform, except as generally permitted through the Platform’s functionality for your personal, non-commercial use, without our prior written consent.

7. Limitation of Liability

• To the fullest extent permitted by applicable law, KognitivAtlas shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform; (ii) any conduct or content of any third party on the Platform; (iii.any content obtained from the Platform; or (iv) unauthorized access, use, or alteration of your transmissions or content.
• We do not guarantee the uninterrupted, secure, or error-free operation of the Platform, and you acknowledge that technical difficulties, maintenance, or external factors may temporarily disrupt access to the services. KognitivAtlas is not a booking agent and is not responsible for issues arising from bookings made with third-party providers based on information from the Platform.

8. Indemnification

• You agree to defend, indemnify, and hold harmless KognitivAtlas, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including, but not limited to, your User Content, any use of the Platform's content, services, and products other than as expressly authorized in these Terms.

9. Termination

• We may terminate or suspend your access to all or part of the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
• Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or contact us to delete your account.

10. Governing Law

• These Terms and Conditions shall be governed by and construed in accordance with the laws of [Your Jurisdiction - e.g., the State of California, United States or your country of incorporation], without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within [Your Jurisdiction] for the resolution of any disputes.
